PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING AS A PATIENT OR RECEIVING TREATMENT AT STAR ORAL SURGERY, YOU AGREE TO BE BOUND BY THESE TERMS.

1. Parties and Scope

These Terms of Service (“Terms”) constitute a binding agreement between you (“Patient”) and Star Oral Surgery (“Practice”), operated by Jeffrey Scott Bobst, DDS. These Terms govern your use of our services, website, patient portal, and all communications channels, including text messaging.

If you are a parent or legal guardian consenting on behalf of a minor patient, all references to “you” or “Patient” include you in that representative capacity.

2. Services Provided

Star Oral Surgery provides oral surgery and related services, which may include tooth extractions, dental implants, bone grafting, oral pathology treatment, jaw surgery, and other procedures within the scope of oral and maxillofacial surgery.

These Terms do not guarantee specific treatment outcomes. The Practice will provide care in accordance with the applicable standard of care. All surgical procedures carry inherent risks that will be explained to you through separate informed consent documentation prior to any procedure.

3. Patient Responsibilities

To receive safe and effective care, you agree to:

  • Provide complete and accurate medical, dental, and medication history
  • Disclose all current medications, supplements, and allergies
  • Notify the Practice immediately of any changes to your health status or medications
  • Follow all pre-operative and post-operative instructions provided by the Practice
  • Arrive on time for scheduled appointments
  • Provide accurate insurance and billing information
  • Maintain current contact information with the Practice, including a valid mobile number if you consent to text messaging
  • Treat Practice staff and other patients with respect

4. Appointment Scheduling, Cancellation, and No-Show Policy

Scheduling

Appointments may be scheduled by phone, through our online portal (if available), or in person. All appointments are subject to provider availability.

Cancellation

We request at least 48 hours’ advance notice for any cancellation. To cancel, please call our office at (208) 297-6760 or reply to an appointment reminder text if you have consented to text communications.

Late Cancellations and No-Shows

Cancellations with fewer than 24 hours’ notice, or missed appointments without notice, may result in a fee as posted in our office. Repeated no-shows may result in discharge from the Practice. The Practice reserves the right to require a deposit to schedule future appointments following repeated cancellations.

Late Arrivals

Patients arriving more than 15 minutes late may need to be rescheduled to avoid disruption to other patients’ care.

5. Text Message (SMS/MMS) Communications

Consent to Text Messaging

By providing your mobile telephone number to Star Oral Surgery — on a patient registration form, verbally, or through any other means — and by not opting out, you expressly consent to receive text messages (SMS/MMS) from us or on our behalf at that number. Consent to receive text messages is not a condition of receiving treatment.

Text messages will be used only for the following purposes:

  • Appointment reminders and confirmations
  • Appointment rescheduling notifications
  • Post-operative follow-up reminders
  • Responses to text messages you initiate

HIPAA Compliance

Star Oral Surgery is committed to HIPAA compliance in all communications, including text messaging. We will limit the PHI included in any text message to the minimum necessary for the stated purpose — typically your name and appointment information. We will not send detailed clinical information via standard SMS without your explicit written authorization.

Standard SMS/MMS messages are not end-to-end encrypted. By consenting to this communication method, you acknowledge this limitation. If you require encrypted communications, please inform us and we will accommodate your preference.

Third-Party Messaging Services

We may use a HIPAA-compliant third-party platform to deliver text messages. Such platforms operate under Business Associate Agreements with the Practice and are contractually required to safeguard your PHI.

Opting Out

You may withdraw consent to receive text messages at any time, free of charge, and without affecting your access to care, by:

  • Replying STOP to any text message from Star Oral Surgery
  • Calling us at (208) 297-6760
  • Providing written notice at the front desk

Following opt-out, you will receive one confirmation message and no further texts except in response to messages you initiate.

Message Frequency and Carrier Rates

Message frequency varies based on your appointment activity. Standard message and data rates from your wireless carrier may apply. Star Oral Surgery is not responsible for any charges imposed by your carrier.

6. Financial Responsibility and Insurance

Patient Financial Responsibility

You are ultimately responsible for all charges incurred for services rendered, regardless of insurance coverage. If your insurer pays less than expected, you are responsible for the remaining balance. Payment is due at the time of service unless prior arrangements have been made.

Insurance Verification

As a courtesy, we will verify your dental insurance benefits and submit claims on your behalf. Benefit estimates provided are not guarantees of payment. Final coverage is determined solely by your insurer.

Past-Due Accounts

Accounts with unpaid balances past 90 days may be referred to a third-party collection agency. You agree to be responsible for any collection costs, attorney’s fees, or court costs incurred in collecting amounts owed.

7. Privacy and HIPAA

Your health information is protected under HIPAA and applicable state privacy laws. Our Notice of Privacy Practices, provided to you separately and available on this website, describes in full how we use and disclose your Protected Health Information.

By acknowledging receipt of the Notice of Privacy Practices, you confirm your understanding of our privacy practices. These Terms complement and do not replace the Notice of Privacy Practices.

8. Treatment of Minors

Patients under the age of 18 must be accompanied by a parent or legal guardian, who must sign all consent and financial responsibility forms on the minor’s behalf. A parent or legal guardian must also provide consent for text message communications on behalf of a minor.

9. Clinical Photographs and Imaging

The Practice may take clinical photographs, X-rays, and other diagnostic images as part of your treatment. These records are part of your PHI and are maintained confidentially. De-identified clinical images may be used for educational or quality improvement purposes. Identifiable images will not be shared publicly without your separate written authorization.

10. Website Use

The content on staroralsurgeon.com is provided for general informational purposes only and does not constitute medical or dental advice. Use of this website does not create a patient-provider relationship. Do not rely on website content as a substitute for professional care. In a medical emergency, call 911 or go to the nearest emergency room.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Practice’s liability for any claim arising out of or related to these Terms or the services provided shall be limited to the amount you paid for the specific service giving rise to the claim in the six months preceding the claim.

The Practice is not liable for indirect, incidental, special, or consequential damages, including those arising from delayed or failed text message delivery, missed appointments due to communication failures, or disruptions outside the Practice’s reasonable control.

12. Governing Law

These Terms are governed by the laws of the state in which the Practice is located, without regard to conflict-of-law principles. Any dispute not resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Modifications

The Practice reserves the right to modify these Terms at any time. Updated Terms will be posted on this website and at our office. Continued receipt of services after changes take effect constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
